KIDGY PRIVACY POLICY

PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE USING THE APPLICATION.

This Privacy Policy describes the privacy practices for the Website kidgy.com (the Website)and KIDGY application for parental control (the Application) and how the Website operated by KIDGY collect and use the personal data you provide. It also describes the rights available to you regarding your personal data, our processing and protection of your personal data and how you can access, update, change or delete this data.

In this Privacy Policy “user”, “you”, “your”, “yours” means a parent and\or legal guardian of a child/children.

In this Privacy Policy “we”, “us” and “our” means “KIDGY”.

  1. 1. Personal Data Collection and Use

With the purpose of your usage of KIDGY we need to collect and process personal data about you and/or your users that can be collected by us through the use of KIDGY (hereinafter the "Data"). Data are as follows:

Browsing. We store information and also collect, which is generated automatically as you navigate through our Website to enhance your experience on our Website by using tracking technologies as Cookies, Log Files and Pixel tags.

Registration. You should be more than 18 years old to register an account with KIDGY. On registering for KIDGY, we will collect the following personal data as email address (“Registration Data”). In case you register through Facebook or Google Plus we will receive from the later your personal data as name, surname and email address. This data is obligatory and if they are not provided, an account cannot be created.

Online Stores. KIDGY application for parental control is available on Appstore https://itunes.apple.com/us/app/kidgy-parental-control-app/id1212520608 and Google PlayMarket https://play.google.com/store/apps/details?id=com.kidgy.android . Your personal data is collected and processed by these stores according to their terms and privacy policy which is provided to you here: https://www.apple.com/legal/privacy/en-ww/ and https://policies.google.com/privacy

Payments. Online Stores collect certain payment data which is processed according to their terms and privacy policy which is provided to you during the payment process. See https://www.apple.com/legal/internet-services/terms/site.html and https://payments.google.com/payments/apis-secure/u/0/get_legal_document?ldt=buyertos . We may contract further payment gateways, and their conditions will be provided to you during the payment process.

Web-forms. If you submit any web-form to us (Contacts, comments), we collect the data indicated in the forms indicated in and submitted through these forms by you, including name and email address. Required data in order to send the web-form is indicated. This data is used for processing your request and contacting you for further communication.

Information about your computer. Due to the communications standards on the internet, when you visit our Website we automatically receive the URL of the site from which you came and the site to which you are going when you leave the site. We also receive the internet protocol (“IP”) address of your computer and the type of web browser you are using. We use this information to analyze overall trends and to help improve the service. This information is not shared with third parties without your permission.

  1. 2. Children’s Privacy

The Children's Online Privacy Protection Act ("COPPA") requires us to inform parents and legal guardians about how we collect, use, and disclose personal information from children under the age of 13, which is described in this Privacy Policy as well.

We do not knowingly collect personal information from children or sell any products to children. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children to never provide information in our Application without their permission. We take children’s privacy seriously, and encourage the parents and legal guardians of children to play an active role in their children’s online experience at all times.

We collect private information from a child provided by you and with your consent needed for the registration in the Application as: name, age and gender with the purpose to install the Application to a child’s target device. We do not request additional information about a child such as address, email, birth date, username and password, his/her grade in school etc.

KIDGY provides you, as a parent or legal guardian of a child or children under the age of 18, with the ability to collect and access tracked information through linked devices. For the avoidance of doubt, KIDGY will not provide for your ability to collect and access the tracked information of any child (i) for whom you are not the legal guardian or (ii) who is 18 years of age or older, as more thoroughly explained in the Terms of Use governing the use of the Website and the Application.

You are solely responsible for the tracked information accessed by you or any third party you have permitted to use the Application and you agree to the Disclaimer of Warranties of the Terms of Use governing the use of the Website and the Application.

  1. 3. Use of your Child's Personal Information

We use the personal information that we collect from your child to provide you with the Service explained in the Terms of Use governing the use of the Website and the Application.

We may use non-personal information such as information about the pages visited to improve the design, content and performance of our Website.

We may use non-personal information to analyze the frequency of the Application usage and the popularity of certain features in the Application, or any analytical data to improve the operation of the Application.

We may use information collected selectively from and based on the logs files to gather market information for analytical research to improve the operation of the Application.

You may request information from us on the type of data being collected, view your child's information, and, if you choose, prohibit us from making further use of your child's information.

  1. 4. No Share of your Child's Personal Information with any Third Parties

We will not sell, rent or trade your child's personal information.

We will not disclose your child’s personal information and downloaded information from target device(s) except as provided by “Legal Matters” below.

  1. 5. Legal Matters

KIDGY considers your use of its service to be private. However, we may disclose your personal information stored in your account and/or on KIDGY servers and databases, in order to:
(1) comply with the law or legal process served on us;
(2) enforce and investigate potential violations of this contract; including use of this service to participate in, or facilitate, activities that violate the law;
(3) investigate potential fraudulent activities; or
(4) protect the rights, property, or safety of KIDGY, its employees, its customers or the public.

We may also disclose personally identifiable information in response to legal proceedings - for example, in response to a court order or a subpoena. We may also disclose such information where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms or this Policy, or as otherwise required by law.

You are solely responsible for use of KIDGY and the processing of personal data associated (linked) with your account, which includes, among others, collecting, storing and analysing personal data from a target device.

You warrant, as the one responsible for your child (children)’s data that we process on your behalf as data processor, that (a) you are parent or legal guardian of a child or children under the age of 18, and (b) you comply with all applicable legislation with respect to the monitoring and control software. You provide us with your consent by agreeing to fully comply with this Privacy Policy.

In the event of a change of control of KIDGY (such as asset transfers through a merger, sale, assignment or liquidation of the business entity, or any of its properties, assets or equity) or, in the event of a direct or indirect sale of any of its publishing properties and/or its Website, personal information of users of the affected Website in our possession will be transferred to the new owner/successor. We are not obligated to notify Web site users of any such transaction. You may always change or delete your information or opt out by contacting us as provided below, or if the acquirer posts a new Privacy Policy with new contact information, you may change or delete your information or opt out by following any new instructions that are posted.

Please be advised that all logs and data downloaded from a target device with use of the KIDGY Software stored in KIDGY database dated more than 40 (forty) days will be automatically deleted for the reasons of security.

  1. 6. Consent

By completing the forms and registering for an account with KIDGY, you declare to have read and accepted the terms of this Policy. Without prejudice to the generality of the foregoing, you expressly and unequivocally consent to:

  1. the collection and processing of your personal data by us in accordance with the indicated purposes and this Policy;
  2. the collection and processing of your child (children) Data on your behalf, as indicated herein; and
  3. the processing of all personal data stated in this Privacy Policy outside the European Economic Area (particularly in the United States of America) by the following subcontractors (data processors) including but not limited to: Google Inc. and Apple Inc. for the purposes indicated above.
  1. 7. User’s rights

You have the right to access, rectify, erase, block and oppose any processing of your personal data that we may have. Moreover, you may at any time withdraw your consent to the processing of your personal data and information.

We generally retain your Data and information from a child (children)’s device(s) on an identifiable basis for 12 month periods, for providing our annual behaviour report. It is then gets deleted. In addition, through the account, you may delete all historical data saved at any time. This data will no longer be accessible and will be fully removed from our systems on the next back-up, except as indicated below.

If you wish to remove all Data in your account, please, uninstall KIDGY from your device(s), and send an email to support@kidgy.com. (or click on “Delete my Account” button in your account). Once received your request your Account will be permanently removed within 30 days or earlier from our active systems, servers and back-ups. By deleting your account all your personal data and gathered information from a child target device will be removed as well.

The aforementioned rights may be effective by contacting us at support@kidgy.com.

  1. 8. How to opt out or change your personal information

To opt out of further e-mail communications from us, in case you no longer want to receive our newsletter, emails or other announcements, you may push the unsubscribe link at the bottom of our emails or unsubscribe by writing to us at support@kidgy.com. In this case we may need up to 3 (three) business days to assure compliance with your request.

Please note that you cannot unsubscribe from certain correspondence from us, including messages relating to your account transactions.

To change your personal data that you have provided us, please contact us as instructed at the end of this Privacy Policy.

  1. 9. Our Commitment to Data Security

We have adopted technical and organizational measures to preserve and protect your personal data from unauthorized use or access and from being altered, lost or misused, taking into account the technological state of art, the features of the information stored and the risks to which information is exposed.

Although we have exercised high levels of care in providing secure transmission of information between the Application and our servers and in storing that information on our systems, no method of transmission over the Internet, or of electronic storage, is 100% secure. As such, we cannot ensure or otherwise guarantee the security of information transmitted to us over the Internet.

Any employee with access to personal data is required to protect this information in a manner that is consistent with this Privacy Policy and may not use the information for any purpose other than to carry out the services they are performing for KIDGY. These individuals may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

  1. 10. Changes or Updates to this Privacy Policy

We may modify this Privacy Policy at any time, so please review it frequently.

Any changes will affect all of the information we have previously collected from you, as well as the information we collect after such changes, and may include without limitation additional uses or disclosures of your information.

If you object to the changes, please contact us as provided below and we will remove your information that we previously collected. However, your subsequent provision of information to us through the Application is deemed your agreement to use of that information in accordance with the then-current Privacy Policy.

  1. 11. Governing Law

This Privacy Policy is governed by and construed with the laws of England and Wales including UK Data Protection Act, and will be interpreted in accordance with the English courts. The English courts shall have exclusive jurisdiction to settle any claim or dispute which might arise out of or in connection with this Privacy Policy.

Those who access the website from locations outside of the United Kingdom are responsible for compliance with local laws if and to the extent that local laws are applicable.
